FLXN GENERAL TERMS AND CONDITIONS | Dance School Eindhoven

Article 1: Definitions

  • Organiser: FLXN
  • Overeenkomst: De overeenkomst is gebaseerd op deze algemene forwaarden van FLXN, waarin the deelnemers een schriftelijke overeenkomst aangaan for the diensten van FLXN.

Article 2: Applicability

2.1 These terms and conditions apply when a participant has entered into an agreement for FLXN dance classes. These terms apply to every activity. Participants use FLXN’s services at their own risk. Before using any facility or taking part in any activity, each participant must ensure that doing so is medically responsible for them. In addition, every participant must be insured against accidents. If FLXN advises a dancer to obtain a referral letter from their GP before starting training, the dancer must do so.

Article 3: Payment terms and rates

3.1 FLXN will collect the membership fee and one-off registration fee in the first week of the month. If you enrol halfway through the month, the first direct debit may include two invoices. The amount will then be included with the direct debit for the following month. For example, if you enrol halfway through August, in September you will receive an invoice for the second half of August and the full month of September. Payments are always made in advance. Membership fees for that month are collected in the first week of the month.

3.2 The membership fee is based on an annual price. This annual amount is paid in 12 instalments, so you pay the same amount during holiday periods. You can find the membership fees under ‘rates’ on the website. A demoteam subscription is always taken out for 12 months; after that period, it can be cancelled monthly.

3.3 If, in FLXN’s opinion, a member’s payment behaviour warrants it, FLXN may exclude the member from further classes and deny them access to the dance school. Any amounts owed by the member to FLXN for any reason will then become immediately payable.

3.4 Taking out a membership creates an obligation for the customer to pay FLXN. If the customer reverses a monthly direct debit without FLXN’s express consent, FLXN may recover any additional transaction costs incurred from the customer.

3.5 If a membership fee payment is reversed, FLXN charges an administration fee of € 10,-. If a membership fee cannot be collected, FLXN will send a free payment reminder by email. If the membership is not paid within 14 days, FLXN will instruct a debt collection agency. If we have not received the outstanding amount within these 14 days, we will refer the claim for collection to Van Hoek & Partners Incassoservices B.V. All resulting costs will also be charged to you in accordance with the Debt Collection Act of 01-07-2012; for the first € 2500,-, collection costs are 15% of the principal amount, with a minimum of € 40,-, and may rise to a maximum of € 6775,-.

3.6 FLXN indexes membership fees once a year in January. Any communication about an increase outside the indexation is sent by email. FLXN may also increase the membership fee once a year independently of indexation. If you do not agree with the increase, you may cancel or amend your subscription free of charge from the date of the change. If a member reaches a certain age (under the subscription terms), FLXN may increase the subscription in line with the applicable subscription fees.

3.7 FLXN does not refund membership fees.

3.8 You can buy class passes from FLXN for 1 drop-in class, 5 classes or 10 classes. Buy this product on the FLXN website by clicking ‘enrol now’. A class pass is valid for 90 days. You must book a class in the FLXN app to attend.

Article 4: Cancelling membership

4.1 Membership is for an indefinite period and starts when the customer selects and activates a subscription. The customer can activate the subscription in the ‘FLXN’ app or in the online members’ portal.

4.2 There is a one-month notice period. You can end your membership using the online cancellation form, which can be found on the FLXN website. If you cancel before on the 1st of the month, your subscription will be cancelled from the following month. So cancelling before 1 January means it ends from 1 February. If you submit the cancellation form on 5 January, your subscription ends on 1 March.

Article 5: Liability

5.1 FLXN is not liable for theft or loss of belongings.

5.2 FLXN is not liable if a dancer suffers damage in any other way where the damage is attributable to failure to follow verbal or written instructions given, or to the participant’s physical or mental condition.

5.3 Any injuries must be reported to the instructor before class.

5.4 The dancer hereby waives any and all rights to bring a claim against FLXN for reimbursement of costs, damages and interest resulting from any accident or injury arising from the services offered by FLXN. The dancer must indemnify FLXN against damage they cause to other participants.

Article 6: FLXN’s obligations

6.1 FLXN is obliged to supervise participants as well as possible, taking into account the purpose and nature of the activity. FLXN determines the content and number of participants. FLXN provides dance classes to the best of its knowledge, expertise and ability. This is an obligation to use reasonable endeavours; FLXN does not guarantee the success of the service or the extent to which it contributes to the participant’s stated objective.

6.2 If the instructor is ill or absent, participants will be informed in good time where possible. Classes will, where possible, be made up at a later date and/or a substitute instructor will be provided.

6.3 Force majeure in relation to the agreement means anything understood as such under legislation and case law. FLXN is not bound by its obligations under the agreement if performance has become impossible due to force majeure. The agreement will then be terminated.
If a teacher is ill or a class is cancelled due to force majeure, an alternative will be offered to the dancer where possible. During holidays and public holidays, the national school holiday dates apply, unless the dancer is informed otherwise.

Article 7: House rules

7.1 FLXN’s house rules form part of these general terms and conditions and will be sent as an appendix.

Article 8: Confidentiality

8.1 FLXN is obliged to maintain strict confidentiality regarding information received from and about the dancer. The dancer’s personal data is strictly confidential and is used solely for FLXN’s administrative purposes. Such data is never made available to third parties for commercial purposes. By submitting the registration form (physically or digitally), you give FLXN permission to post photos and/or videos of the dancers on online channels. If you do not wish this, you must notify us in writing.

Article 9: Disputes

9.1 Dancers may contact FLXN with any complaints. Any disputes concerning the formation, interpretation or performance of the agreement, or agreements arising from it, may be submitted to the competent court in the district where FLXN is based. Dutch law applies in all cases.

By signing the registration form or agreeing to the online registration form on the website, you agree to FLXN’s terms and conditions.
